I have seen product liability from both sides, so I really understand how the industry looks at it. A lot of the time, the courts take liability for products too far. People sue for injuries resulting from their own negligence and often take home millions of dollars that they don't deserve, money that cuts into corporate profits. It is understandable why they want to keep product liability to a minimum. On the other hand, when someone is unjustly injured because of defective workmanship, almost everyone would agree that they deserve some form of compensation. Cars manufactured with defective brakes, furnaces with dangerous leaks, and other of defective products have injured or killed thousands. Those that survive and their families certainly deserve some type of recompense.
Of course, there are many different kinds of product liabilities. Sometimes, it is a matter of defective workmanship. These cases are pretty simple and straightforward. Something breaks that shouldn't, and someone gets hurt. At other times, however, product liability is not so clear. If people are using a product in a manner inconsistent with its labeling, there's a question as to whether or not the company is responsible if they get hurt. If you are hurt by a defective product and feel that it may have been unjust, it never hurts to check out your legal rights. After all, you might be entitled to a settlement. It would be a shame to let that settlement go if it is rightfully yours, particularly if you have been seriously injured and need the money.
